The Supreme Court Sucks Butt

In today’s news from the Associated Press: “Federal authorities may prosecute sick people who smoke pot on doctors' orders, the Supreme Court ruled Monday, concluding that state medical marijuana laws do not protect users from a federal ban on the drug.”

This makes me sick. And not just because I may or may not be a libertarian or because I may or may not smoke dope, but because people who are ill need the stuff. The two Californian women who brought the case against John Ashcroft (who also makes me want to vomit) are suffering between them: scoliosis, a brain tumour, partial paralysis, degenerative spine disease, chronic nausea, fatigue and pain, as well as a few other more minor ailments.

What the fuck is the Supreme Court’s problem? In the decision, Justice John Paul "Arsehole" Stevens wrote that it is up to Congress to change the law to allow medical use of marijuana. That might be fair play, except for the fact that the distribution of medical marijuana in California is without charge and does not involve “interstate commerce” in any way. Under the Constitution, that means that Congress has no say in the matter. Perhaps our eminent justices need to go back to law school.

It's more proof that politicians have nothing but disdain for the citizens. Politicians say they embrace democracy until a vote doesn't go the way they planned. In this case, California voters voted in favor of the use of marijuana for medical purposes. Well, D.C. doesn't like that,(gets in the way of their War on Drugs) so they exert their authority on the state of California like any two-bit dictator in a Banana Republic would do. It's shameful.

In the good old days of Federalism, the states claimed the right to decide whether a law was unconstitutional or not, regardless of the ruling of the Supreme Court. The idea that the states had the last say was behind the Kentucky Resolve and Virginia Resolve written by Jefferson and Madison, respectively, in response to the Alien and Sedition Act. They basically say in the resolutions that the Act was unconstitutional and, therefore, is null and void and should be ignored. Bravo! to those two.

Maybe we should hold the Supreme Court members down and blow smoke in their faces. Fucking a-holes.

Who cares about this shit! If pot makes sick people feel better they should just smoke it. Luckly it's not hard to find and everyone is sparking up regardless if they are sick. My point is, is that there is not sense in getting upset over this political bullshit because we all know the people in politics are not really looking out for the benefit of the people but rather themselves.
I am still pondering what the big fucking deal is about legalising gay marriage in Canada. Christ! what is the big deal! if two people love each other let them unite! The fact that they are muff divers or fudge packers or both...that is their private business just like any heterosexual couple's sex life.
The church not allowing it is a whole other thing, it is against religion so I am more accepting of this decision though I will leave this discussion for another time, in the meantime however there are catholic churches and priests who accept homosexuality. It's rare but it happens you just have to find it.
So quit ranting about shit you have no power over and start dishing the dirt about the summer heat making you all sticky and wet and what you are gonna do about it with all the euro tourists coming into town in hords!
I spent the afternoon in little italy at Cafe Sportivo watching football/soccer and flirting with nice Italian boys and their "DO IT" dad's. The granddad's are the ones who love me, and buy me Brio and alcoholic beverages. BIG SMILE!

Thank you for today's rant, Mad Canadian. The thing is, you weird, that I have to worry about stuff because I do have power, at the very least the power to make my voice heard.

And yes, I can skin up right here in my flat or in the park over the road because there is no law against it where I live. But how the hell are sick people in my home country going to get dope if they can't grow it or receive it, but have to go out on the streets and find some cracked-out drug dealer in the hopes that he will sell it to them for a fair price?

And it's not hot here right now anyway, it's about 14 C and pissing it down. www.meteopress.cz

And another thing, Canadian, don't defend the church on my blog. Homosexuality is not "against religion". I think you will find that the hate comes from the side of religion.

AG said...

Thanks, Max and DD. However, you must understand that Congress and the Senate will never legalize marijuana because the people who lobby for control of drugs are making money on the side.

Just a side note, I'll bet Jay Leno probably can't fine 5 people under the age of 25 on the streets of LA LA Land who even know who Jefferson or Madison were.

If we're going to talk about religion, Canadian, and you mention homosexuality - why not talk about the Catholic church's acceptance of pedophiles in their midst. Fuck the Catholic church. I'd rather talk to a priest or a minister who's a homosexual, fudge packer or muff diver, than a God damned pedophile.

AG,

You classifying the entire Catholic church as a bunch of pedophiles is a bunch of shit. It is a very small percentage that the media has exposed day in and day out. Why don't you mention that the Catholic church is one of the biggest charitable organizations in the world? Whether or not you agree with its teachings is beside the point. No one in the Catholic church has accepted pedophilia that is just your take on it. Millions upon millions of dollars have been reserved for settlements and priest have been kicked out. I guess under your terms it is safe to say that homosexuals are a bunch of AIDS spreading, promiscuous, cross-dressers? That's the impression I get from movies and MTV so it must be true. Go Fuck yourself, bigot.

The Catholic church is one of the biggest charitable organizations in the world? And that justifies the hate, fear and violence that this cabal has perpetuated over the last 1,000 years? You might consider turning off your television and opening your eyes to reality.

And don't call our AG a bigot, you motherfucker.

All right, can everyone just calm down, please, stop putting words into each other's mouths and leave off the name-calling. Thank you.

The thing is, that in addition to the belief that marijuana should be legal and available for medical purposes, there is a bigger issue here. Has anyone read Justice Thomas' dissent? Here is the opening paragraph:

Respondents Diane Monson and Angel Raich use marijuana that has never
been bought or sold, that has never crossed state lines, and that has had no demonstrable effect on the national market for marijuana. If Congress can regulate this under the Commerce Clause, then it can regulate virtually anything - and the Federal Government is no longer
one of limited and enumerated powers.

Reading on - here is an extract from Justice O'Connor's dissent:

We would do well to recall how James Madison, the father of the Constitution, described our system of joint sovereignty to the people of New York: “The powers delegated by the proposed constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite… The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State.” – The Federalist No. 45

Oh, and here's more from a little document we call The Bill of Rights: the 10th Amendment to the Constitution of the United States says "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

The Supreme Court shat all over that yesterday.

unfortunatly some religions do not approve homosexuality and are against it. Maybe not in those exact words. I don't know many religions who welcome it. However thanks to progessive preists and church goers there are catholic and protestant churches who will support homosexuality and perhaps even perform a service of matrimony.

I am sorry max but it's not that hard to find pot in your country. Pot is not the only medicinal relief the governement or medical professionals are against. Some still do not acknowledge homeopathy such as acupuncture and raiki.

relax and have a joint and don't stress about your home country. Luckly you live in a cool open country.

in addition to the catholic church...well this could be a long conversation but just to make it clear...I have lost faith in the catholic church a long time ago. I find it's teachings hypocritical and I don't share the same beliefs. Not all catholic priests are bigots or pediphiles. The St. Thomas Church in Mala Strana is pretty open or at least Father John I think his name is.
The canadian governement is just wasting it's time with the whole gay marriage issue. Most us including the prime minister is all for it but he is trying not to piss anymore people off especially since he has lost some credibility with the whole Sponsorship scandal. As for legalizing pot well it will happen. Most of the pot farms are up in BC and they already have pot cafe's. Canada is pretty slack and open with that. There is a task force of some sort that monitor's the pot farms and I believe in march or a few months ago there was a shoot out up in alberta between a potfarmer who shot and killed 6 RCMP's. It was a horrible day.
I don't have the solution to your questions. I consider myself a pretty open person. your voice is heard max all the way to Canada no worries.

I found out that the Canadian government (6pm news two nights ago) has spent 24 million dollars on researching pot growing in a mine somewhere "for security reasons". They got hte plants in silver mirrors with the heavy dudy lamps, the segment was hysterical! THey grew tonnes of crop and are freezing it and selling it to people who need it for medical reasons. ONly thing is the people who are buying for medical purposes say it sucks ass. So they are going back to growing their own little stashes in their garden's and basements or simply buying hte good shit from someone else. Meanwhile the government is freezing the pot they grew while they sell it off. WTF? Is it me am I just blonde or does this seem insane? Why don't they just legalize it man? BC has loads of pot farms so does quebec ostie! BC has the best pot I ever smoked. I had a hard time sleeping this winter with my loud nieghbours so sometimes I use it for "medicinal purposes" as well. Otherwise I hate the shit.

In addition, I think gays may marry legally in Toronto Ontario or some provinces however the Canadian government is looking into legalizing gay marriage in the whole country and then there is the questions of under which terms blah blah blah. There is a show hosted by former Kids in the Hall star Scott Thompson (who isn't very friendly in person may I add) called My Fabulous Gay Wedding a show where him and his team organize gay dream weddings. I saw it last night and it's quite cool. Great ideas for decor!
I think Canada is pretty advanced in terms of legislation. Despite the scandals we have a pretty progressive government in the East at least. It's a question of convincing evil Stephen "I have devil's eyes" Harper to chill out and light up and embrace the love by all people. peace out!
